What is this privacy policy actually about?

Welcome to our company profile! When you view our posts or write to us, your personal data are processed by us as well as by the social network. You have probably already taken a look at the privacy policy of Facebook or Instagram to adjust your settings. There, you will find most of the information on data processing. However, we also inform you about the data processing attributable to us.

What are Insights data?

When you access our profile, so-called Insights data are collected. These aggregate statistics are created based on certain actions logged by Facebook and Instagram. It mainly concerns how users interact with the profile and other content on Instagram.

We are not able to identify you personally via the Insights data. We cannot assign the data to a profile. For us, the Insights data are part of the functions provided by the social network. We cannot unilaterally decide whether we process these data. They are a non-derogable part of Facebook’s and Instagram’s Terms of Use. The same applies to you. You have agreed to the Terms of Use and contractually permitted the processing when you created your own profile. If you do not accept the Terms of Use, you cannot maintain a profile on Facebook or Instagram. In this respect, the provision of Insights data is necessary for use.

Insights data are also collected from people who do not have a Facebook or Instagram profile. In this case, however, the visitor is asked for consent prior to accessing the pages – no content can be viewed without such consent.

Facebook and Instagram base the lawfulness of the processing of Insights data on Art. 6 para. 1 f) GDPR (legitimate interest). The social network uses the data mainly to optimise the advertisements. We use the data to improve our profile for our users and to provide content that is read by many users. To increase our reach (and thus our turnover), we need many views and a lot of traffic on our profile. The more we adapt the content to the interests of our users, the sooner we can achieve this.

Insights data collected via our profile are processed anonymously. This means that the data are changed in such a way that they can no longer be assigned to an identified or identifiable natural person, or only with a disproportionate amount of time, cost and effort.

Who is responsible for the data processing?

The processing of Insights data takes place in the context of joint responsibility between us and the social network. This is a special case under privacy law according to Art. 26 GDPR. Therefore, we have concluded a contract with the social network that regulates the handling of the Insights data and, above all, the fulfilment of data subjects’ rights.

The social network Facebook or Instagram is operated by Facebook Ireland Ltd. The social network is primarily responsible for the processing of the Insights data with regard to a legal basis that exists.

How do you communicate via Facebook or Instagram?

We use our Facebook and Instagram profiles to contact and interact with you. This is possible via direct messages, the “like” feature or comments. In this context, the name that is stored in your profile as a user name is always displayed.

The lawfulness of this processing is based on Art. 6 para. 1 f) GDPR (legitimate interest). Communication with you is important for us to answer questions, respond to criticism, build a relationship and exchange information. This is the only way we can improve our services and respond to your needs.

Comments are stored on our profile for an unlimited period of time and can be viewed by other users. The same applies to the use of the “like” feature. Direct messages are also stored, but deleted at regular intervals. The rhythm is based on our internal deletion concept.

You can use the various communication options, but you do not have to. You can also view the contents of our profile in this way.

Who will receive my data?

The data processed when using Facebook and Instagram are transferred to the social network’s servers and stored there. Direct messages are viewed and answered by our staff. All other actions are publicly viewable on our profile and can also be commented on by other users. Facebook or Instagram can be accessed via the internet all over the world, therefore, access is also possible from countries without an adequate level of privacy. Please be aware of the above when using social networks and the internet in general.

The Insights data are partly transmitted to servers of Facebook Inc. in the USA and stored there. This process is lawful without further approval by the EU Commission, as the social network has included effective standard data protection clauses approved by the EU Commission for the entire global data exchange.

Can I object to the processing of Insights data?

The Insights data are also used for advertising purposes, therefore, there is a fundamental right to object according to Art. 21 GDPR. The social network provides an online form for the assertion of the right to object. You can also assert this right against us and we will then forward the request to Facebook or Instagram.

Please note that in the event of an objection to the processing of Insights data, the use of Facebook or Instagram and the access to our profile will only be possible to a limited extent or not at all.

What rights do you have?

You have quite a few rights with regard to privacy. The GDPR has some articles that only deal with these rights and we have to inform you about them accordingly.

You have the right to exercise all your privacy rights against the social network as well as against us. Under the agreement between us and Facebook or Instagram, if the social network is solely required to comply with your privacy rights, we will forward your request without undue delay.

You have the right of access (Art. 15 GDPR), rectification (Art. 16 GDPR), erasure (Art. 17 GDPR), restriction of processing (Art. 18 GDPR) and data portability (Art. 20 GDPR).
You have the right to lodge a complaint with the competent supervisory authority at any time.
